The table below summarizes the FAR’s requirements, which basically substitute ADS-B OUT where a Mode C transponder is required now.
Additionally, FAR 91.225 includes two ways to avoid having to have ADS-B OUT installed in the above airspace: Request an ATC-authorized deviation at least an hour before it’s needed, as detailed in FAR 91.225(g)(2), or be operating “any aircraft that was not originally certificated with an electrical system, or that has not subsequently been certified with such a system installed, including balloons and gliders.”
