Knowing you'll Fail Is Same As Failing the med. -------------------------------------------------------------------------------- Somewhere in the FARs I read that if you know you will fail the med exam for Private Pilot, it doesn't mean you can avoid taking an exam then apply for a Sport pilot cert. Dont ask me how they know you knew. Maybe you have to sign a statement to that effect. You can however, be an Flight Instructor without a medical certificate. If you are already an instructor, you can instruct, like for BFR's, but the pilot you're checking has to qualify as PIC. such as getting a BFR before the old one expires. dd

That is not exactly what the FARs say. If you know that you have a medical condition that would make it unsafe for you to fly you are obligated to not fly. The medical conditions you must meet for sport pilot are equivalent to those required for your state driver's license. In fact having a valid driver's license meets the sport pilot medical requirement. In other words, if you are fit enough to drive you are fit enough to legally fly as a sport pilot.
Periodic lapses in health that would or should make you unwilling to drive, for instance if you have the flu or just broke your leg, should also make you unwilling to fly until such time as your health is restored. If your doctor tells you that you should no longer drive, you should also no longer fly as a sport pilot. That is not the same thing as being able to pass an FAA Class III medical exam. Sport pilots do not need to be able to have a Class III medical, period. They do not need to meet the same requirements. People who say otherwise are misinformed.
